Mufti Abu Layth says he loves al-Shawkani but disagrees with him on this point, and shows that Shawkani himself went against claimed consensuses: the ijma that musical instruments are haram reported by Hanafi and Shafi'i scholars; the ijma, recorded by al-Nawawi and others, that one must follow one of the four madhhabs; and the ijma reported by Ibn Hajar, al-Shafi'i, Ibn Qudama, al-Nawawi and al-Qurtubi that a man may not marry more than four wives, which Shawkani permitted, calling the contrary hadith weak, with Siddiq Hasan Khan agreeing in his commentary. He adds, warning that people will be upset, that Shawkani also went against the claimed consensus on anal intercourse in marriage, a point Mufti had earlier cited to show diversity. He notes Shawkani held raising the hands in prayer to be mutawatir from over thirty companions, yet those who quote him on Jesus do not adopt it. He then turns to the belief that the Prophet's parents are in the Fire, which most early scholars accepted on the basis of a hadith in Sahih Muslim, with al-Nawawi titling a chapter accordingly and Mulla Ali al-Qari writing a book claiming ijma on it, as did Ibrahim al-Halabi.
