26 Jan 2021Monday Nights with Mufti Abu Layth
How could hadith chains and texts have been standardised over time?
Mufti Abu Layth says editors who standardised variant chains and texts, as Ahmad Shakir did with Ibn Jurayj's version, erased how reports were really transmitted, and that this may have happened unnoticed in the classical collections.

Will you critique Sahih Muslim like you did al-Bukhari?
Mufti Abu Layth chose al-Bukhari, not Muslim or others, because it is the symbol of the Salafi-Wahhabi legacy; that is the fortress he wanted to take on.

Is drawing lots or playing the lottery haram in Islam?
Mufti Abu Layth says drawing lots is an established principle of the Shari'ah, and that a small lottery stake is not haram, though he does not encourage it.

I stopped praying because it feels mechanical and forced; will I go to hell?
Pray out of gratitude and connection, not fear of hell, and do not develop hatred for the prayer even if you slack or combine prayers; each person's journey is their own. The Prophet told a Companion who slept past dawn simply to pray when he wakes.

If possession were real, why is there no sahih hadith of the Prophet casting out a jinn?
The Gospels make exorcism a chief miracle of Jesus, but the Quran never mentions it and there is no sahih hadith of the Prophet casting out a jinn, so the guest calls the belief overstated. Following Bilal Philips's study, he says the symptoms match psychological illness and medical treatment should come first.

Does a triple talaq count as one divorce or three?
The guest says triple talaq drives many to the Ahl al-Hadith view that it counts as one, while some Ahl al-Hadith scholars privately hold it counts as three but will not publish this for fear of controversy.

Why did Abu Bakr refuse to give Fadak to Fatima?
Abu Bakr cited the hadith that prophets leave no inheritance; Shia sources say Fadak had been gifted to Fatima, while Sunni sources say the Prophet did not give it to her.

Which scholars held that music is permissible, and what did Imam Malik's school say?
Al-Shawkani, Ibn Hazm, Abu Bakr ibn al-Arabi and al-Fakihani all found no sahih hadith prohibiting music, and the people of Madinah, including the qadi Sa'd ibn Ibrahim, held it permissible, with some transmitting this as Imam Malik's own position. Only Allah and His Messenger are authorities, so a refutation needs a sahih hadith.

Why is everything permissible by default in Islamic law unless proven haram?
By default everything is conclusively permissible, since Allah created everything on earth for us and what He was silent about is pardoned, and that certainty can only be removed by certainty, not by a hadith that remains probable. So Mufti Abu Layth does not declare music halal; Allah has, and the evidence against it falls short of overturning that.

Does Islam say homosexuals should be thrown off buildings or executed?
There is no sahih hadith in which the Prophet spoke about homosexuals, the reports of Ali ordering executions are not authentic in Mufti Abu Layth's view, and the early jurists disagreed, with the Hanafis holding it is not a hadd offence. The claim of a consensus that homosexual acts deserve death is false.

What are the three points of Yasir Qadhi's khutbah on orthodoxy, and is hadith certain knowledge?
The khutbah's three points are that reinterpreting the Quran through reason or science is heresy, that doubting the hadith sources is heresy, and that a radical new interpretation amounts to claiming prophethood. Mufti Abu Layth agrees that rejecting hadith wholesale is wrong but says the hadith quoted for it is weak and that hadith is khabar ahad, not certain knowledge.

What is the war-wager hadith paradox?
Mufti Abu Layth presents the report that the Prophet was commanded to fight people until they believe, which hadith dogmatists call mutawatir, and notes that the same scholars agree no one may be fought merely for disbelief or compelled into Islam.

Was the Prophet Muhammad poisoned, and did he die from it?
No: Mufti Abu Layth says the Prophet did not die of poisoning. The report in Bukhari that he felt the poison cutting his aorta in his final illness is, in his view, a fabricated story that contradicts itself and fails on its chain.

17 Sep 2018On the Prophet Muhammad ﷺ
Is the chain of the hadith that the Prophet died of poison reliable?
Mufti Abu Layth finds the chains unacceptable: the Bukhari version runs through Yunus, whom early critics faulted for his memory, and through al-Zuhri, who does not state that he heard it, while the Abu Dawud version has a narrator criticised for mistakes.

How can the same poison kill one companion at once and the Prophet three years later?
The story contradicts itself: the companion who ate the food died at once, so the same poison cannot have killed the Prophet three years later, and the Prophet in Muslim's version says Allah would not let the woman do it.

What is the context of the hadith 'whoever changes his religion, kill him'?
The report 'whoever changes his religion, kill him' clashes with the Quran, and in full it is Ikrima's account of Ali burning people alive and Ibn Abbas objecting that he should have executed them instead.

Would the Prophet really call a woman wearing perfume a fornicator?

Does Ali's saying about wiping the socks prove that religion is not based on reason?
No: Mufti Abu Layth says the 'if the deen were by opinion' wording has a weak chain and is absent from several versions, that Malik's Muwatta records wiping both sides of the khuff, and that rituals are practices rather than claims against reason.

Music: the hadith on singing and hypocrisy, and scholars who permitted music

Anal intercourse: the difference of opinion and the chains of the critic's hadith

Is a short back and sides or faded haircut haram?
A short back and sides, or hair of unequal lengths, is permissible and does not fall under the hadith forbidding qaza'. Shaving patches and leaving others (qaza') is at most disliked, not haram, in the view he presents, unless done to disfigure or to imitate a religious practice.
