What this part covers
machinesummary, machine-writtenIn the early school of Abu Hanifa, someone without water could make wudu with nabidh, a weak fermented date drink, and he helped people out of rash conditional divorce oaths, unlike the sterner Imam Malik.
In more detail
Mufti Abu Layth gives an example of the ease Abu Hanifa created: when water was hard to find, in an age when travellers often drank fermented drinks because they were less likely to carry germs, as Roman soldiers drank weak beer, one could make wudu with nabidh, a fermented date drink with perhaps around one percent alcohol. He explains that such a negligible amount of alcohol was not haram in the early school of Abu Hanifa, while noting that later Hanafis disagreed, and he says Islam's move away from fermented alternatives pushed Muslims to build aqueducts and bring in water. He adds that people of that age created self-inflicted problems by making their wives' divorce conditional on all sorts of things and then came to Abu Hanifa to find a way out. He contrasts Imam Malik, also a voice of reason but with zero tolerance for such cases and a serious manner, with Abu Hanifa's jolly, people-loving personality, which he links to his upbringing as a businessman.

spirit of the method changes it becomes all about the letter of the law it's all about things become most things become Haram most things are very and I suppose they've got their justifications they're saying that's the reason but it but it's very opposite to the spirit that Imam Abu hanifa brought you know he he brought this trying to make welcome everyone and never say things are uh you know very reluctant to say things are Haram very trying to create ease you know oh you're struggling with this well why don't you pray in Farsi or you're doing this why don't you just do it like that you know that to the extent that they said well oh if a person was
struggling to make wudu he couldn't find water he's about see in that day and age people you know you might be in a place you can't find what you see water in the past it's it's it's interesting because today water is just on tap so it's everywhere but in in the past it's not I mean obviously people had water but sometimes when people were traveling and doing things they may take certain fermented drinks because it was less likely to have bacteria in it and it's actually more healthy so this is why for example this is why the Roman soldiers or you know they would drink
beer as opposed to water because obviously the beer had a very low alcohol content but it would because it was less likely to contain germs whereas if you just drank water chances are it's not like water today you know you just water in the past some of it would just led to infections and it could have been infested and I'm not saying all water but I'm just saying that there and it's true Islam it kind of forced people to say well no we're going to move away from this whole fermented uh Alternatives and therefore Muslims by had to you know Necessities the mother of invention so they had to invent all
these aqueducts and bring water in and and do all of that so that which was great but in his time you might have had people that have nabiv which is a very low content kind of um almost like a beer kind of no except Nabis would be from really date so I don't know whether you'd call that up but it was like a fermented date drink so you probably had very low alcohol content like maybe I don't know one percent or you know something like that so it wasn't that alcoholic but it would have had uh some alcoholic content but it wasn't Haram according to the hanafi
mother because it's it's a tiny amount of uh it's negligible so that kind of um tiny percentage of alcohol of ethanol uh you see we say alcohol ethanol is not it's negligible according to to that method I know the hanafies have disagreed but according to the early school anyway would have been look if you couldn't find water you could do wood with Nabis you can take this fermented thing and just do wood with it like look creating ease for people and a lot of people would come to the Imam
when they were stuck and he would help them find a way out and you know in that day and age as well people as well they they are stupid problems because they would you know they would self-inflicted people would take all these Customs um and they would say things like um they would say things like oh if I do this then my wife's divorced or if that happens my wife's divorce you know on every other thing they applies did and they're stuck they've come to the likes of Imam see because the likes of Imam Malik were very different
Imam Malik was also a voice of reason but he had like zero tolerance for uh you know if a person came like this oh I said this about my wife I said this deal he wouldn't be entertaining it he wouldn't even be he would just he wouldn't be part of that conversation he would just be gone and he'd be like don't ever disturb me again for your stupidity you know Imam Malik was a very serious he had a more serious uh tone to him Imam hanifa was more a very uh a very jolly exuberant like people's person and
and you could see this coming back to his his trade and businessman kind of because because that's how he grew up he was a very you know he was a very successful businessman so yeah so people would approach him he would help them he would say well okay do this do this this is a you know this is how it can be and people did they rated his Brilliance for for really doing stuff like that there's a you know there's a uh there's an incident I'll share some stories with you guys right so from I think I shared this one before once they say that
